Firstly, @sweetgeek you have the most beautiful heart and you've always been one of my favourites here because you've got so much warmth and empathy for others. That detailed Post you did on all the Housemates was so wonderful, and it brought me close to tears, and I wasn't even a Housemate, because it brought back memories of every single one of them. And I totally agree with you about Ben, and I'm so glad to see prufrock and bleachy_dude speak up and support Ben as well. I realise there was talk about Ben putting on an act, but Ben's funniest moments were genuine. For example, who could forget when they were all in bed, and all of a sudden there was a loud bang in the bedroom, and it gave Ben a terrible fright and he sat up wondering what the hell happened. He actually thought the insulation had fallen from the ceiling and crashed down ha ha ha ha. :D

I'm sorry that Ben got an awful fright, but I can't explain it. When I saw that, I laughed so much and even the next day at work, I got into trouble because I got a case of the giggles every time I thought about it. I remember he was wearing those things on your eyes to block out the light. I'm trying to shorten my Posts, so I'm going to send this, and start another Post on another moment where I really laughed at Ben.

Infact I nearly set up a Thread in the Housemates Section titled, "What moments in the House made you laugh the most" because every single Housemate had some really funny moments, and I would love to see some more comedy and humour regarding the Housemates. And Sparrow11, I watched that UTube link. And I loved it because it was so crazy it was funny ha ha ha. We have all been to family gatherings when arguments break out, and if that ever happens, I come home and watch UTube pranks and sit here laughing until I feel better.

Your posts are so entertaining Sapphire! I absolutely loved that scene in the bedroom too!! The boys had a great time when they were in there! Funny you should mention still laughing the next day at a Ben moment...when they were doing Mandate (or some Irish dance, can't remember) and he fell off the stage... Just hilarious!! I belly laughed for days whenever I thought about it...still laughing now hahahahahaaa!!!

Hope the links work for anyone up for a laugh!!

I love how people who have never meet Tully can claim that she is poison and drew who spent time in and out of the BB house with her should listen to some stranger on twitter.

Right? "You'd better have dumped your girlfriend because I don't like her. Your fan, Mr. Balding Perth Real Estate Agent."

I love Ben! It's been a while since I've posted here but I just had to right now after seeing your comments on him. I was becoming wary of Ben after he kept thanking people on social media every day, but now I realise that's who he is- a warm, friendly and thankful person. I should have never doubted him.

I remember reading the posts on here the night Ben was evicted and I was surprised and upset that quite a lot of posters were happy to see him gone. Anyway, I'm glad Ben has a lot of fans right now because he really deserves it. And to think that he thought he would have nothing to come back to! Hopefully we get to see what he and Tim get up to when they go to Graceland!

I think the reason most people on here were happy that Ben was evicted because it looked like he had the game in the bag, so once he was evicted the game opened up a lot more for the other HMs to take out the win. Just my opinion though.

Oh, I never thought of it that way. In my opinion, both Tim and Ben had a good chance of winning but I do agree that the outcome of the game was harder to predict once Ben was evicted.

Like this sort of thing, from what appears to be a middle-aged man?!

I loved that one, although "I'm in the pool" was my fave. I loved too the conversation with Drew where he said, "I don't wear glasses…I'm not even gay." Watching Drew and Ben together generally made me smile.

Unless Australian law in this regard is the opposite of US and English law, I believe the burden of proof that the claims are true and therefore not libelous/defamatory would actually be on the defendant if she opts for that line of defence. Can anyone confirm?
No, the burden of proof is always on the person who is laying the charges.

He is new to twitter, I think. So he may not have have the same idea as most as to how twitter is viewed perhaps. So I think he may be a little socially awkward with its use. But like you said, it's also bens nature to be thankful and gracious. He was all about manners in the house don't forget. I still think of when he was in the spa and he was complaining about something Matt had said. Ben was saying how he always says thank you and is the first to say hello, oh it was hilarious to me lol. I remember your old avatar with Ben and Tim. You were one of the people I agreed with in regards to Ben. I also was upset with how Ben was perceived by many, and the night he was evicted, I was so glad that I saw others on hear supporting him. Again, you were one of them. I don't expect there to be a load of supporters, but all it takes is a few to remind some posters of what a contestant contributed to this experience.

Never doubt yourself either, no one knows you better than yourself :)

Generally, yes, but I'm talking about using truth as a defence.

http://www.thenewsmanual.net/Resources/medialaw_in_australia_02.html

Truth (which is also called justification) is probably the best defence. Formerly in some states (such as NSW, Queensland, Tasmania and the ACT) truth was only a defence if you could prove that a ‘public interest’ was served by publishing the defamatory words. This requirement has been dropped from the Uniform Defamation Law and now there is a defence if the defendant can prove that the defamatory imputations are substantially true.

Sapphire, you really know how to make a person feel good about themselves. That was so lovely to read. But it should be known that it was your post when you first came back that was my inspiration for today's post, so this is all your work. I'm glad your back, you keep being you :)

That is the funniest thing, because I had intended doing the exact same thing you did today, where you listed the Housemates and then thought of something positive to say about each one of them. The only reason I haven't done it was lack of time. I know how much time it takes, that's why I was really impressed with what you did. And you listed the Housemates in Alphabetical Order ha ha ha. And I know exactly what your talking about with Mikkayla. I wanted to give her a big hug and tell her that she's beautiful just as she is. I remember seeing her in the Diary Room one time, and her eyes looked extra lovely, but I didn't know at first why. Then I realised she had no eye make up on, and her eyes look even better WITHOUT eye makup.

And I loved the clip of her in bed when she was trying to sleep and Mr Clooney was pulling the doona off her ha ha ha, and OMG when she got evicted, well BB must've let Mr Clooney out to say goodbye. As soon as Mikkayla saw him ....I started crying and I couldn't stop. :( Even if you've had a pet you've been in charge of for many weeks you still bond with them, and if that was me, they would've had to drag me out, or I would've been in the Diary Room saying, "Can I please have Mr Clooney to take home with me?" ha ha ha. I think she already had 2 dogs.

But I struggle to leave my pet to go to work, because he gets upset every time I'm about to leave, and sits at the window waiting for me to come home. When I get home there are days that I can't keep playing with him for hours (he is a cat, not a dog) so I bought a little remote control car, and when I first get home and I'm tired and I want to sit down for an hour, I hold the little control thing in my hand, and I can get the little car to race up and down my kitchen and loungeroom, plus it goes forwards and backyards and it can turn around, so I don't have to get up, and he is thoroughly entertained and exhausted lol. But I still play with him and his toys, but I'm talking about when I first get home.

And bloody mongrels are picking at Tully on Twitter for selling some clothes. Maybe these same people would like to go and pay Tully's Rent or House Payments. It's incredibly dear to live where she is, and I've seen her home in photos on here that people have got from her Instagram or where ever, and it would be so expensive. I saw Drew sitting in her courtyard. It looks really nice and I'm sure I saw Yukka Plants. I know them because I've got them in my yard.

I completely forgot about one really exciting thing I saw in this Thread and I forgot to comment on it. Congratulations are in order for a certain someone. :p I'm going back to find the quote.

This is so good of you to do- thank you!

Oh gosh, that mandate scene where he falls- bahaha!

No, the burden of proof is always on the person who is laying the charges.
Absolutely incorrect and it's why when a magazine or newspaper is sued in Australia, it's up to them to prove that what they said about someone is true and not up to the person doing the suing. If Tahan and David went after Leesa, either she needs to provide proof that what she said is correct or she loses the case. They don't have to prove that it's not.

"Australia’s defamation laws are heavily biased towards plaintiffs. This has a dire effect on freedom of expression in Australia. Perhaps the most eloquent denunciation of Australia’s defamation laws can be found in Justice Deane’s minority judgment in Theophanous v Herald & Weekly Times Ltd. He notes that that the law makes it easy for the plaintiff to succeed. As Deane J explained, ‘a person who publishes an assertion of fact or a comment which injures (or is “likely” to injure) the reputation of another person is guilty of a tort and liable in damages unless he or she can positively justify or excuse the publication in the particular circumstances of the case.’ Thus, ‘a plaintiff may succeed notwithstanding that he or she calls no evidence to establish either that the defamatory statement was false or that the defendant was motivated by malice or was guilty of negligence or some other fault.’ The High Court has recently affirmed that to be defamatory, the ‘general test’ is ‘whether the published matter is likely to lead an ordinary reasonable person to think the less of a plaintiff’."

I loved that one, although "I'm in the pool" was my fave. I loved too the conversation with drew too where he said, "I don't wear glasses…I'm not even gay." Watching Drew and Ben together generally made me smile.

Speaking of drew and Ben... Ben was really himself around drew (googly eyed around him too- but who can blame him ;)).

Remember that scene where Ben and drew were talking about jasmine and Ben cracked the best line that had drew laughing. He said (paraphrasing), all you had to say is highschool and jasmine would be like ooh I have a story- I died from laughter at that lol. The attitude Ben said it with was perfect too.

This was the only time I actually found Ben funny. This is the side of Ben they should have been showing / encouraging, because staying in his pyjamas 24/7 and talking to his photos do not make good TV viewing.

I searched for that one with no luck! Also the one where Tim is asking him if he could stay with him/the pie and coke deal breaker!!

Aww, they went to the drive in!

tee_smyth: Just experienced my first drive in movie experience complete with 1950's diner food. #burgersandhotdogs DREWBB13 got a Twinkie.

I loved that. The scene that possibly touched me most was when Ben came back as the elf. The look on his face when he was hugging Drew good-bye was really poignant. Ben's face is an open book, and i must admit that all I could think was that I hoped he could find a gay man to love like that who would love him back. (Yes, I am a closet romantic…my secret is well and truly out.)
